Three appeals arose from two civil suits involving Tan Sri Dato' Seri Dr M Mahadevan (TSM), David Choong (DC), and Lee Kuang Gen (LKG). DC sued TSM, alleging illegal money lending under the Moneylenders Act 1951 (MLA). TSM counter-sued DC and LKG for collusion in gold investment schemes. The High Court ruled in favor of TSM, but the Court of Appeal reversed the decision, declaring the SOGAs void under the MLA as disguised money lending transactions.
