The Plaintiff, Ladang Venu (M) Sdn. Bhd., purchased two condominium units from the Defendant, D Pristine Medini Sdn. Bhd., under separate Sale and Purchase Agreements (SPAs). The Plaintiff claimed that the Defendant breached the SPAs by failing to deliver vacant possession and issuing a partial Certificate of Completion and Compliance (CCC) instead of a full CCC. The Plaintiff sought rescission of the SPAs, return of payments, and damages. The High Court dismissed the Plaintiff's claims, finding that the Defendant had complied with the SPAs by delivering vacant possession and issuing a valid partial CCC. The Plaintiff appealed the decision.
