SWM Greentech Sdn. Bhd. & Anor v Ketua Pengarah Jabatan Pengurusan Sisa Pepejal Negara & Anor

The Plaintiffs, SWM Greentech Sdn. Bhd. and SWM Environment Sdn. Bhd., filed an Originating Summons on 6.5.2020 seeking declarations regarding an indemnity clause in an O&M Agreement with the Defendants, Ketua Pengarah Jabatan Pengurusan Sisa Pepejal Negara and Kerajaan Malaysia. The Plaintiffs sought indemnity following a demand and legal action by SAJ Ranhill Sdn Bhd for alleged pollution from the Plaintiffs' landfill operations. The High Court of Malaya at Johor Bahru, presided by Judicial Commissioner Dato’ Fredrick Indran X.A. Nicholas, granted the declarations on 16.12.2020, ruling that the indemnity clause was triggered by the demand and subsequent legal action.
