Sinohydro Corporation (M) Sdn Bhd v KAJ Development Sdn Bhd
The Court of Appeal allowed Sinohydro's appeal against the High Court's decision to set aside an ex parte Prohibitory Order (PO) obtained over 13 parcels of land. Sinohydro, a contractor for the Melaka Gateway Project, had obtained the PO to enforce an Adjudication Decision under CIPAA 2012. The High Court had set aside the PO citing material non-disclosure, but the Court of Appeal found Sinohydro had complied with all requirements under Order 47 Rule 6 of the Rules of Court 2012. The Court restored the Deputy Registrar's order and awarded costs to Sinohydro.
