Badrul Hisham Bin Mohd Salleh v. IOI City Mall Sdn Bhd & Ors
The Plaintiff, Badrul Hisham Bin Mohd Salleh, filed a civil suit against IOI City Mall Sdn Bhd (First Defendant), IOI City Park Sdn Bhd (Second Defendant), and Anand A/L Gopalan (Third Defendant) for unpaid salary, litigation costs, and exemplary damages. The First Defendant applied to strike out the Plaintiff's claim under O.18 r.19 of the Rules of Court 2012, arguing that the claim was unsustainable. The court allowed the First Defendant's application, striking out the Plaintiff's claim with costs fixed at RM2,000. The court found no privity of contract between the Plaintiff and the First Defendant, dismissed the res judicata argument, and ruled that the First Defendant was not liable for malicious prosecution.
