Chia Soo Nee v Karak Land Sdn Bhd

Chia Soo Nee filed a winding up petition against Karak Land Sdn Bhd under sections 465(1)(e), (h), 466 and 476 of the Companies Act 2016, alleging the company was unable to pay debts and it was just and equitable to wind up the company. The petition was based on a previous judgment that was later overturned on appeal. The High Court dismissed the petition, finding that the petitioner was no longer a creditor and had no locus standi, and that winding up was not just and equitable. Costs of RM15,000 were awarded to the respondent.
